The Construction Lien Law replaced the Mechanic’s Lien law changing the landscape of liens for materialman’s good and services. This seminar will review the history of both the Mechanic’s and Construction Lien Laws. Compare and contrast the two. Breaking down the specific statutory process required to assert a Lien Claim on both residential and commercial property. We will examine acceptable underwriting practices regarding such Lien Claims and how to determine the validity of same. The seminar will also explore regulatory matters that might be called into question in the Title Insurance Policy, such as Conservation Easements, Green Acres designation, Wetlands and Flood Zones, Mergers & Subdivisions along with other governmental powers that might concern the Title Producer.
