Attendees at this seminar will receive an in-depth examination of the challenges presented with waterfront properties. In the aftermath of Super Storm Sandy, knowledge of Riparian Rights and Tidelands Claims are a must for Title Producers operating throughout New Jersey. NJ Tidelands Resource Council Member, Joseph A. Grabas, CTP, NTP, will discuss the issues of NJ State property claims to lands now or formerly flowed by tidal waters. Beginning with the history of sovereign claims to navigable waterways and how they morphed into the current Tidelands Claim System. He will outline the NJDEP’s basis for establishing title claims, review of the pertinent Claims Maps and the process of applying for a Grant, Lease or License from the State of New Jersey for lands claimed under the aforementioned maps, using specific applications and case studies to illuminate the myriad of intricacies which can appear during the process.
Upon successful completion of this course, students will have a better understanding of Water Rights and Tidelands Claims and how they can affect a real estate transaction. They will be introduced to the title investigation necessary to transfer title free and clear of all claims by the State of New Jersey. All students will be better prepared to confidently represent the consumer in acquiring good title to waterfront properties.
