This seminar looks deeply into current practices of title producers acting as settlement agents. We define the additional duties that are assumed when acting as settlement and/or escrow agent. The proper management of funds received from the lender or as escrow agent. Recent HUD rulings regarding markups and kickbacks will be examined. Review of the obligations the settlement agent has to the borrower/purchaser when an attorney represents them and when they are not represented. Forms of disclosures and waivers will be analyzed along with the body of federal law (RESPA) that regulates the practice of residential real estate closings. The seminar attendee will walk away with a comprehensive understanding of the accepted practices that Settlement Agents can engage in.
